Adventist Church Sue FG & INEC: Elders of Seventh Day Adventist have dragged Independent National Electoral Commission INEC, Federal Government and the Attorney General of the Federation to court. This was as a result of the continuous holding of elections on Saturday.
According to the applicants in the matter, holding elections on Saturday leads to disenfranchisement and violation of the rights of other members of their church.
Following the suit, PHC/2836/2018, the applicants ask the court to declare that holding elections on Saturday, is a violation of the church members right.
The suit which reads that the declaration by the applicants’ recognizes worship days being Saturday, they are therefore entitled to their freedom of religion and worship on Saturdays uninterrupted by anyways, whatsoever, under the Constitution of the Federal Republic of Nigeria 1999 (as amended).
“A declaration that scheduling of the 2019 presidential and National Assembly elections on Saturday, February 16, 2019, and the gubernatorial and state Assembly elections. Federal Capital Territory FCT council elections on Saturday, March 2, by the first respondent, in accordance with the second and third respondents, constitute a violation of the applicants’ fundamental Human rights to freedom of religion.”
However, the applicants, therefore, said their rights being violated are guaranteed under Section 38 of the constitution of the Federal Republic of Nigeria 1999, and In Article 8 of the African Charter Act, Cap A9 on Human and People’s Enforcement and Ratification.
The applicants further ask the court to make an order of injunction restraining the third defendants, INEC, from conducting the 2019 election as fixed or fixing any other elections on Saturday.
Though, when the matter arose yesterday, in court, Owurre Ahamefule, Counsel to the applicants, asked for an adjournment, to allow him to reply counter affidavit of the defence on point of law.
He said the desire of the applicants is that elections be scheduled between Monday and Thursday to allow many persons to participate in the process.
However, the trial judge, Justice Danagogo .M, adjourned the matter till December 18, for motions.
Recall, In 2011, the Adventist church sue FG issue over the general election raised dust. This is because it’s members are being disenfranchised through fixing of election dates on Saturdays and urged the government to move election days to enable its members to participate.
Also, INEC chairman, Attahiru Jega was called by the church to reconsider changing the election time table to enable its members participate in the exercise.
